Seasonal Parking Ban in Effect

Dear Town of Ausable Residents,

With winter weather already upon us, we’re issuing this timely refresher on the Seasonal Parking Ban, now formalized under Local Law #2 of 2024 (“Town of Ausable Parking Ban”). This law strengthens our long-standing efforts to keep town roads clear for safe snow removal, emergency access, and everyday travel. High compliance last season helped us navigate heavy storms efficiently—thank you for your partnership!

Key Details from Local Law #2 of 2024:

• Effective Period: The ban applies November 1 through March 31 each year, from 10:00 p.m. to 8:00 a.m. daily. No on-street parking is allowed during these hours on any town roads, drives, streets, lanes, cul-de-sacs, or avenues.
• Purpose: To ensure unobstructed passage for vehicles, plows, and maintenance crews, while promoting public health, safety, and welfare by reducing hazards from snow buildup and blocked routes.
• Affected Areas: All Town-maintained roads in AuSable, Clinton County, NY—residential streets included. This does not apply to state highways or private drives.
• Why Comply? Parked vehicles during overnight hours or storms can delay plowing, create icy patches, and endanger residents, first responders, and property.

Exceptions (When Parking is Allowed):

Under Section 5 of the Local Law, the ban does not apply if:

• Directed by a police officer, traffic sign, or signal.
• Temporarily loading/unloading merchandise, passengers, or property.
• Operated by police, firefighters, ambulance drivers, or other emergency personnel on duty.
• Due to a vehicle breakdown (limited to 4 hours while repairs are attempted).

Enforcement and Penalties:

• Who Enforces? The Clinton County Sheriff’s Department issues appearance tickets, which are returnable before a Town Justice. Tickets include vehicle details (make, plate, color) and must be served directly if occupied or affixed to the windshield if unoccupied.
• Towing: Violating vehicles may be towed by designated providers.
• Fines: Treated as a traffic infraction under NY Vehicle and Traffic Law (e.g., Article 45). Convictions can result in fines, points, or surcharges—exact amounts determined by the court. Repeat offenses may escalate penalties.
